2021Fire Service Legislation Budget Update
The budget bill, SB 105, as previously released in draft includes several major fire service provisions. There is discussion that the Bill may be voted on this week and sent to the Governor. To our knowledge it still contains: – $15,000,000 in funding to the Department of Insurance to Establish and administer a pilot program (firefighter cancer insurance) to provide health benefits to firefighter diagnosed with cancer after January 1, 2022; – A registry of fire department stocks and usage of AFF foams containing PFA’s, maintained by OSFM; – Adds two additional types of cancer to LODD (Oral and Pharynx), and changes Intestinal Cancer to Cancers of the small Intestine. What is included in the final budget will depend upon negotiations that have occurred in both Chambers. Firefighter Cancer insurance was a Priority for our Legislative Committee this year and it is currently included. Senate Bill 311 passed which makes various changes to the Local Government Retirement, but also expands reduction fo matching funds under the Volunteer Fire Department Grant Fund.
Here is an update on activities at the Federal Level.
Our Federal Legislation efforts on retirement issues for non-profits lost a lot of momentum when our provision was removed from the Brady Retirement Bill due to IAFF opposition. If you follow federal legislative issues, you’ve seen where indications are the Brady bill will pass this session. Since the House Ways and Means Committee removed our provision, we’ve been working with Senator Burr’s Office to try and get it put back in when it crosses to the Senate. If you are interested in this effort, please contact Senator Burrs office or Senator Tillis and ask them to add it back when it crosses to the Senate. It’s an uphill battle but that is our best hope to see this language passed.
Federal legislation Currently Under Consideration (Provided by NVFC)
Fire Police Fairness Act OVERVIEW: The Fire Police Fairness Act clarifies that members of fire departments who perform traffic incident management duties at the scene of emergencies and planned special events – commonly referred to as “fire police” – are firefighters for the purposes of eligibility for the Public Safety Officers’ Benefit. This would simplify the process by which fire police officers are able to qualify for PSOB, which has become unnecessarily complicated in recent years. CURRENT STATUS: On June 10, 2021, the U.S. Senate passed the Protecting America’s First Responders Act (S. 1511), which contained the Fire Police Fairness Act language. H.R. 2936, House legislation identical to S. 1511, was introduced by Representatives Bill Pascrell (D-NJ) and Brian Fitzpatrick (R-PA) on April 10, 2021. HERO Act (H.R. 1480/S. 2700) OVERVIEW: The HERO Act establishes a series of programs designed to address public safety behavioral health issues, including: = Creating a grant program for peer-Support behavioral health and wellness programs at fire and EMS departments = Directing the U.S. Fire Administration in coordination with the Department of Health and Human Services to develop and make publicly available resources to be used by the federal government and other entities to educate mental health professionals about the unique behavioral health issues that firefighters and EMS personnel face = Establishing a system for collecting data on suicide deaths of public safety officers CURRENT STATUS: The HERO Act was introduced on March 2, 2021 by Representatives Ami Bera (D-CA) and Brian Fitzpatrick (R-PA). On May 12 the House passed H.R. 1480.
Volunteer First Responder Housing Act (H.R. 4377/S. 2316) OVERVIEW: The Volunteer First Responder Housing Act would increase access for qualified volunteer firefighters and EMS personnel to two existing federal housing assistance programs. The bill would expand eligibility for qualified volunteers to receive a loan through the Single Family Housing Guaranteed Loan Program, administered by the U.S. Department of Agriculture. It would also make qualified volunteers eligible to participate in the Good Neighbor Next Door Sales Program, through the U.S. Department of Housing and Urban Development (HUD). CURRENT STATUS: H.R. 4377 was introduced on July 7, 2021 by Representatives Cynthia Axne (D-IA) and Mike Bost (R-IL). S. 2316 was introduced on July 12, 2021 by Senators Tammy Baldwin (D-WI), Shelley Moore Capito (R-WV), Jon Tester (D-MT), and Kevin Cramer (R-ND).
Current Level of Federal Appropriations Under Consideration
Assistance to Firefighters Grant (AFG) and Staffing for Adequate Fire and Emergency Response (SAFER) OVERVIEW: The AFG program provides funding to fire departments and some non-fire-based EMS agencies to purchase equipment, training, and apparatus. The SAFER grant program provides assistance for the hiring and retention of career firefighters as well as recruitment and retention of volunteer firefighters. Both programs direct funding to recipients based on criteria established by the fire service and a competitive, peer-reviewed grant process. CURRENT STATUS: Congress provided $360 million each for AFG and SAFER in FY 2021, a $5 million increase from the level provided in FY 2020. H.R. 4331, the FY 2022 Homeland Security Appropriations Act, provides $370 million each for AFG and SAFER. U.S. Fire Administration (USFA) CURRENT STATUS: In FY 2021 Congress provided $49.3 million for USFA, a $2.5 million increase over the level provided in FY 2020. H.R. 4331, the FY 2022 Homeland Security Appropriations Act, provides $53.212 million for USFA. Volunteer Fire Assistance (VFA) OVERVIEW: VFA is a grant program that provides funding to rural fire departments on a 50/50 cost share basis to pay for training, equipment, and protective clothing to help them prepare for wildland fires. VFA is administered by the U.S. Forest Service and funds are distributed by state forestry agencies. CURRENT STATUS: Congress funded VFA at $19 million in FY 2021, a $1 million increase over the level provided in FY 2020. H.R. 4372, the FY 2022 Department of the Interior, Environment, and Related Agencies Act, provides $20 million for VFA. National Firefighter Registry (NFR) OVERVIEW: In July 2018, Congress passed the Firefighter Cancer Registry Act, directing the Centers for Disease Control (CDC) to establish a National Firefighter Registry to collect, on a voluntary basis, health, occupational, and other information from firefighters on an ongoing basis. That information will be maintained in the Registry until such time as one of the participating firefighters contracts cancer, at which point the information will be deidentified and matched with data from existing state cancer registries. The idea is to create a large dataset from which public health researchers and others can draw from learn more about the causes of firefighter cancer in order to better treat and prevent it. CURRENT STATUS: The Firefighter Cancer Registry Act authorizes $2.5 million per year to be spent by the CDC for the purpose of developing and maintaining the NFR. In FY 2021 Congress provided the full $2.5 million for the NFR. H.R. 4502, the FY 2022 Department of Labor, Health and Human Services, and Education Act, provides $2.5 million in funding for the NFR.
Rural EMS Training Grant (SIREN Act) OVERVIEW: In December 2018, Congress passed the SIREN Act, establishing the Rural EMS Training Grant program at the Department of Health and Human Services for rural EMS agencies to help pay for equipment, training, and staffing. SIREN Act grants are capped at $200,000 and there is a ten percent local matching requirement. Public and private, non-profit EMS agencies that serve rural areas are eligible to apply for SIREN Act funding. CURRENT STATUS: In FY 2021 Congress provided $5.5 million for SIREN Act grants. There is no funding for the Rural EMS Training Grant program in H.R. 4502, the FY 2022 Department of Labor, Health and Human Services, and Education Act.
Firefighter Deaths From Covid There seems to be a little confusion concerning Federal PSOB and Covid-19 related deaths. Some people think that you can get NC’s LODD for Covid, but not Federal PSOB. This is not correct. There was a “presumptive bill” passed in Congress in last August for Covid and PSOB, making the assumption that if a public safety officer died of Covid, unless there was specific medical evidence that he died of something else, it would be considered and assumed it was a occupational related death and the benefit would be provided through the end of 2021. In other words, it is our understanding if you die of Covid and you meet the definition of a public safety officer, it is a presumed PSOB covered LODD, with no proof required that is was an occupational exposure. The presumption is only for Federal PSOB through the end of 2021.

2021 legislative Session Update #262021Fire Service Legislation Budget Update
Currently the budget bill, SB 105, has been amended to include several major fire service provisions. Although the budget talks will continue for a few weeks, here is an update and general description on several items that are included in the current version of the budget: – $15,000,000 in funding to the Department of Insurance to Establish and administer a pilot program (firefighter cancer insurance) to provide health benefits to firefighter diagnosed with cancer after January 1, 2022; – A registry of fire department stocks and usage of AFF foams containing PFA’s, maintained by OSFM; – Adding PTS as a workplace injury for firefighters and other emergency responders by modifying the Workers Compensation Statutes under GS 97-53; – Eliminates premiums for the Volunteer Safety Workers Compensation Safety Program for member departments through 2023, meaning departments will not need to pay premiums for Workers Comp if they are under this program until 2024; – Adds two additional types of cancer to LODD (Oral and Pharynx), and changes Intestinal Cancer to Cancers of the small Intestine. More information will be provided once these items are passed as budget provisions, but currently they provide several items of huge benefit to the fire service. Message to Members of Congress: Please cosponsor H.R. 4377/S. 2316, the Volunteer First Responder Housing Act, which would increase access for qualified volunteer firefighters and EMS personnel to two existing federal housing assistance programs. Specifically, the bill would expand eligibility for qualified volunteers to receive a loan through the Single Family Housing Guaranteed Loan Program, administered by the U.S. Department of Agriculture. 85 percent of the nation’s fire departments are staffed by all- or mostly-volunteer personnel. Unfortunately, fire and EMS departments are finding it increasingly difficult to recruit and retain the next generation of volunteers. Roughly one third of firefighters in communities with populations of 2,500 or less are now over the age of 50, up from 18 percent in 2000. There are several reasons for this, but one of the biggest is that working-age people are moving out of or commuting from rural areas to find work. Enhancing volunteer responders’ access to federal housing assistance will help public safety agencies with recruitment and retention while encouraging volunteers to become homeowners, thus increasing their likelihood of remaining in the community long-term.

THE FEDERAL LEGISLATIVE INITIATIVE TO ALLOW NON-PROFIT FIRE DEPARTMENTS TO PARTICIPATE IN LOCAL GOVERNMENT RETIREMENT WAS REMOVED AFTER OPPOSITION FROM THE IAFF.
Federal Legislative Update
Last year we were successful in getting language into the Ways and Means Retirement Bill (Brady Act) that would modify IRS regulations and open the door for North Carolina’s General Assembly to allow career personnel from non-profits into the Local Government Retirement System. The legislation, which includes 132 pages of retirement changes, was not acted on in the last session of Congress.
Our legislative focus this year was to push to have our provision remain included when the bill was re-introduced. Unfortunately, the International Association of Firefighters (IAFF), who opposed our provision, was successful with their lobbying efforts in getting our language dropped from the bill in committee. As such, our language is currently not included in the bill. There are plans by a couple of our Congressional Representatives to try to run a stand alone bill with our provisions, however, not being included in the Retirement Package is a huge loss. We were very close only to have it removed after singular opposition from another fire service organization.
If you speak with your Congress member, ask them to oppose the”Securing a Strong Retirement Act of 2021″, without our amendment.
Background
In early 2018 Past President Jeff Cash from Cherryville set up a meeting with Congressman Patrick McHenry to discuss the issue of non-profits being allowed to join LGERS and the need for federal intervention. The meeting was held in Hickory and attended by members of the NCSFA and NCAFC’s Board and staff. The State law that had initially allowed non-profit career firefighters in LGERS was overturned in the early 2000’s by an IRS opinion letter indicating it would change the status of LGERS, possibly causing it to be taxed differently. At that point the NC law was revoked. For the past two years we have worked closely with Congressman Holding’s and Congressman McHenry’s Office to get federal legislation introduced. One reason for the delay was trying to get a majority of the Ways and Means Committee to agree to the legislation. Also, when the House changed to Democratic in 2018, we had to realign our efforts. There were also issues with the draft legislation. We have been working with McHenry’s and Holdings office hard for the last year, and a few weeks ago we received an indication from Holding’s and McHenry’s office they were ready to move forward with the introduction. The last week before introduction we worked hard to get the remaining members of the NC delegation to sign onto the Bill, and we convinced all but one.
October 6th, 2020, the bill was introduced in the House Of Representatives. HR 8538 went to the Ways and Means Committee, which included it in their major retirement package. This is the first and critical step to removing the Federal IRS restriction that prohibited NC from moving forward. If it had passed in Congress it would have allowed the NC General Assembly the opportunity to re-instate the law allowing participation. The final decision for participation will be getting legislation passed in NC, and the fire department itself agreeing to participate.
We need to get that same piece of legislation reintroduced this year. Now is the time.
IT IS IMPORTANT TO KNOW THAT IF IT PASSES AT THE FEDERAL LEVEL, WE WILL STILL HAVE TO GET IT INTRODUCED AND PASSED AT THE STATE LEVEL.

2021 legislative Session Update #23
Fire Service Legislation Moving Forward
Thursday May 13th, was Legislative Crossover Deadline. This was established long ago to set a deadline for bills that had advanced far enough to be continued in the current biennial session. This means policy bills must pass one chamber and cross over to the other chamber (for example passed the House and carried over to the Senate or vise-versa). This does not include bills that have gone to Appropriations for budget consideration or Finance with a fee. Any bill considered for appropriations or with a fee can still be eligible. Moving forward, the 65 or so bills we were tracking will be trimmed down (to about 30) to those that have crossed, have appropriations or fees in them, or any bill language that may be added to a bill that has crossed over. If you look on the bill list, and it is a House bill assigned to a Senate Committee, it has Crossed. If its a Senate Bill assigned to a House committee, it has crossed. If it is in either Appropriations or Finance committee, House or Senate, it is still eligible. As an update, not necessarily all inclusive, here is where several of our key bills from our list stand and can be considered in our understanding. This does not mean, absolutely, others can’t be added to a bill that has crossed, put in the budget bill or other special actions, but these are those considered to be eligible to move forward, in our unofficial opinion. It does not mean they will be considered.

NC General Assembly Legislation Crossover
The NC General Assembly legislation crossover date is this Thursday, the 13th. Policy bills, or those not affected by appropriations, have to cross from one chamber to the other to still be considered this session. In other words, they have to pass one chamber, or be in appropriations. Obviously the content of any bill can be added to a bill that has crossed, but after Thursday we should have a good indication of our items that may move forward. At the end of the week we’ll send out a status update on all our bills that have crossed or have been referred to appropriations. It’s been a very active session with almost 1000 bills introduced in the House alone. Currently we’re tracking a little over 50 bills in our system, and have been fairly successful in moving our priorities. The House was still introducing bills as late as last nights session, including a Separation Allowance bill for governmental career firefighters.

Fire Service Legislative Day A Success!
Over 170 Firefighters and Fire Officers attended Fire Service Legislative Day, attended committee meetings, visited their legislators, and were involved in lobbying for our key legislative initiatives. We’re grateful to the Department of Insurance and Commissioner Causey for hosting our group in their facility. It was great to see friends and get together. Four of our bills passed committees that day, and you could see the effect of uniformed fire personnel in the room as well as halls of the General Assembly. We were also fortunate to have several key legislators attend our opening, as well as a welcome from Commissioner Mike Causey. 2021 legislative Session Update #19
PTSD Bill (HB642) and Cancer Bill (HB 535) Pass House Health Committee
HB 642 and HB 535 both passed the House Health Committee this morning. Representatives from the NCSFA and Professional Firefighters were present and endorsed the bill. Law enforcement was also on hand to support HB 642.
This year continues to be an active year for bills in the General Assembly. HB 661 was introduced to allow 15 year olds to do fire training at the Community Colleges, which will help with Junior Firefighter Programs. HB 666 was introduced to increase the Fire and Rescue Pension, and HB 652 was introduced to expand the use of Consumer Fireworks.
Please take a look at the summary included with each bill we are tracking on the list and evaluate its effect on your department.
Legislative Day is scheduled for May 5th, Please mark your calendars for attendance. We will be meeting at 8:00 AM in the Insurance Building (Albermarle Building) which is the offices of OSFM, at the corner of Lane Street and Salisbury, right across the street from the Legislative Office Building. There is a visitor parking lot directly beside the building. We will prepare handouts and provide everyone copies.

This year continues to be an active year for bills in the General Assembly. HB 661 was introduced to allow 15 year olds to do fire training at the Community Colleges, which will help with Junior Firefighter Programs. HB 666 was introduced to increase the Fire and Rescue Pension, and HB 652 was introduced to expand the use of Consumer Fireworks.

2021 legislative Session Update #15
HB 535: Firefighter Fighting Cancer Introduced in the House
For over three years the Joint Legislative Committee of the Fire Service has promoted the idea of a Cancer Insurance Bill for Firefighters with Cancer, in lieu of a Presumptive Cancer Bill affecting Workers Comp which has been and would be very difficult to get passed. States like Florida, Georgia, and recently SC have passed similar Cancer Insurance legislation. Over the winter break between Legislative sessions, the NCSFA worked with the League of Municipalities and an Insurance Consultant to draft language for a Cancer Insurance Bill, as well as a recommendation for a funding source. A similar draft to that language was introduced today in HB 535 by Representative Destin Hall and Representative Jason Saine in the House, moving us one step closer to gaining financial protection for firefighters who develop Cancer. Although there are still some funding issues to be tweaked in the language, we feel confident we can move this bill forward with the support of the fire service. Call your Representative today in the House and ask them to support HB 535 with funding changes proposed by the NCSFA.

Federal Legislative Update
Last year we were successful in getting language into the Ways and Means Retirement Bill (Bailey Act) that would modify IRS regulations and open the door for North Carolina’s General Assembly to allow career personnel into the Local Government Retirement System. The legislation, which includes 132 pages of retirement changes, was not acted on in the last session of Congress. As such, it will have to be reintroduced this year. Currently Congressman McHenry’s office, as well as Congressman Price’s office are trying to get all NC Congressional Delegates to sign on to this important piece of legislation. It’s important for you to contact your Congressman again, now, and ask them to support this initiative.
If you speak with your Congress member, ask them to support the reintroduction of H.R. 8696, “Securing a Strong Retirement Act of 2020”, and to continue to include Sec 116 “Governmental Pension Plans May Include Certain Firefighters, EMT’s, and Paramedics”. Section 116 derived from our specific bill introduced last year HR 8538.
Background
In early 2018 Past President Jeff Cash from Cherryville set up a meeting with Congressman Patrick McHenry to discuss the issue of non-profits being allowed to join LGERS and the need for federal intervention. The meeting was held in Hickory and attended by members of the NCSFA and NCAFC’s Board and staff. The State law that had initially allowed non-profit career firefighters in LGERS was overturned in the early 2000’s by an IRS opinion letter indicating it would change the status of LGERS, possibly causing it to be taxed differently. At that point the NC law was revoked. For the past two years we have worked closely with Congressman Holding’s and Congressman McHenry’s Office to get federal legislation introduced. One reason for the delay was trying to get a majority of the Ways and Means Committee to agree to the legislation. Also, when the House changed to Democratic in 2018, we had to realign our efforts. There were also issues with the draft legislation. We have been working with McHenry’s and Holdings office hard for the last year, and a few weeks ago we received an indication from Holding’s and McHenry’s office they were ready to move forward with the introduction. The last week before introduction we worked hard to get the remaining members of the NC delegation to sign onto the Bill, and we convinced all but one.
October 6th, 2020, the bill was introduced in the House Of Representatives. HR 8538 went to the Ways and Means Committee, which included it in their major retirement package. This is the first and critical step to removing the Federal IRS restriction that prohibited NC from moving forward. If it had passed in Congress it would have allowed the NC General Assembly the opportunity to re-instate the law allowing participation. The final decision for participation will be getting legislation passed in NC, and the fire department itself agreeing to participate.
We need to get that same piece of legislation reintroduced this year. Now is the time.
IT IS IMPORTANT TO KNOW THAT IF IT PASSES AT THE FEDERAL LEVEL, WE WILL STILL HAVE TO GET IT INTRODUCED AND PASSED AT THE STATE LEVEL.

Workers Comp traumatic and Trauma Related Injuries Bill Introduced in the House for First Responders (HB 492)
House Bill 492 was introduced in the House yesterday which provides Workers Compensation Coverage for firefighters, law enforcement, and 911 workers affected by Psychological and Trauma related injuries without the occurrence of a physical injury. Currently these injuries are covered only in conjunction with a physical injury.

2021 legislative Session Update #12
Legislative Day is scheduled for May 5th, Please mark your calendars for attendance. More information will be coming in the near future on the specifics. Please plan to attend.
Two new bills were added last night. HB 432 creates a special license plate for the NC Association of Fire Chiefs. SB 374 allows blue lights on the rear of fire apparatus. The bill is worded publicly owned fire apparatus, and the blue lights are only visible from the rear of a fire apparatus when the parking brake is engaged and the on-scene lights are activated.

One particular set of matching bills (HB 355 and SB 327) requires each fire department to report amounts of Class B foam (AFFF) on hand, how much they have that may need to be disposed of, and a summary of how much they use each year and call specifics. The NC OSFM will coordinate, collect, and train departments on this reporting requirement. This is in relation to the foams containing PFA’s and the impact on environment and health of firefighters. The Legislative Committee will be following these bills as they progress.

2021 legislative Session Update #9
Legislative Day is scheduled for May 5th, Please mark your calendars for attendance.
This weeks update adds a couple of additional bills that affect the fire service, inspections and investigations, or individual departments.
One particular bill (HB 315) amends the arson laws and adds NCDOI OSFM to investigations, and requires criminal background checks for career and volunteer applicants. In addition to adding additional items involved with arson penalties, it also will now REQUIRE all applicants of career or volunteer departments to have a background check. Fire Chiefs or Fire Marshals are required to have these background checks conducted. It also allows the results to determine if an applicant is acceptable, lays out certain conditions where exceptions can be made for certain crimes based on age, circumstances, etc., and prohibits membership under any circumstances dealing with felony arson or unlawful burning. It also allows a fire department to dismiss a member or refuse an applicant who is unwilling to have a background check performed. If passed, criminal background checks will be required of all applicants to be firefighters, career or volunteer. The Legislative Committee will be following this bill as it progresses. Another bill (SB 308) prohibits additional inspection charges on residential and commercial on follow-up inspections if additional violations are found checking violations from the previous inspection. Additionally, HB 291 reduces plan review fees for commercial building reviews not completed with 15 days.

Cancer Legislation For the NC Fire Service
During the 2019/2020 Legislative Session the joint Legislative Committee of the NCSFA and NCAFC discussed the priority of Cancer Legislation for the fire service and what needed to be done to secure passage. Both self-funded workers compensation systems used in NC for the fire service feared the passage of presumptive cancer legislation, since it took cancer treatment out of the medical insurance arena and put the total cost on workers compensation insurance. This raised concerns about escalating rates. in addition, some states like Georgia had found that presumptive did not mean automatic coverage since the WC’s carriers could still challenge and deny coverage, and firefighters were still not getting benefits. It was felt that an Insurance alternative, similar to what other States like Florida, South Carolina, and even eventually Georgia had passed, may be a better alternative.
In 2020 representatives from the NC State Firefighters Association (NCSFA) met with representatives from the League of Municipalities (NCLM) and discussed an insurance option as opposed to presumptive cancer. NCLM agreed that this would be a more acceptable option than presumptive legislation. In late 2020, NCSFA again met with the League and an insurance consultant they had brought in from Georgia to discuss an insurance bill. The consultant had been involved in both Florida’s and Georgia’s legislation. A draft cancer insurance bill was developed by the consultant with input from NCSFA from the discussions.
In early 2021, the new Fire Service Joint Legislative Committee (NCSFA, NCAFC, PFFPNC) also agreed an insurance cancer bill may be a better option for passage going into the 2021 session and the specifics of the draft bill were reviewed. During the same time frame, with new Gross Premium Assessment (GPA or GPT) numbers provided by Insurance Commissioner Mike Causey, NCSFA developed a chart with options for increasing the GPA to fund cancer. The specifics of the calculations provided funding for the cancer bill (approximately $130 per firefighter), increased funding for the grant program, increased funding going to the General Fund to be used for the Fire and Rescue Pension program, and kept Relief Fund and VSWCF funding stable with normal growth going into the future.
The draft bill as well as the GPA funding option has been provided to senior legislators in the House and Senate. Last week NCSFA and members of the Joint Fire Service Legislative Committee met with key legislators from the House and Senate to discuss the bill. It is our hope that a bill with be introduced soon in the House and/or Senate. Funding options may change but we have provided them with an option. Here is a synopsis of the bill presented.
Proposed North Carolina Firefighter Cancer Insurance Language
Program Structure Specifics for Drafting
Specific Language Referencing Program as an Alternative to Workers’ Compensation
1. The legislation will include specific language describing the benefit program as an alternative to Workers’ Compensation.
2. The language states that a firefighter who files for a cancer diagnosis in the workers’ compensation is not eligible for the benefits under the alternative program.
Eligibility
1. Continuous Years of Service – To be eligible under the program, the firefighter must have completed five years of service.
2. No Prior Diagnosis of Cancer – To be eligible for the cancer program, a firefighter is required to confirm they had no diagnosis of a covered cancer prior to the effective date of the program.
3. Tobacco Use – A firefighter must confirm they have not used tobacco products within 1 year of their effective date of coverage to be eligible under the program.
4. Definition of Active Firefighter Status – The legislation will reference the statutory definition of an active firefighter in (B)(2) Chapter 58-84-5(3a): “Performs work or training connected with fire protection, fire prevention, fire control, fire education, fire inspection, fire investigation, rescue, Emergency Medical Services, special operations, or performs the statutory duties and responsibilities of the fire chief as set forth in G.S. 160A-292.”
Date of Diagnosis and Compensability
1. A cancer diagnosis must occur on or after the effective date of the program to qualify for the lump-sum benefit.
Cancers Covered under the Program
1. Mesothelioma.
2. Testicular cancer.
3. Intestinal cancer.
4. Esophageal cancer.
5. Multiple myeloma
6. Leukemia
7. Non-Hodgkin’s lymphoma
8. Malignant melanoma
9. Brain cancer
10. Prostate cancer
11. Colon cancer
12. Stomach cancer
13. Kidney cancer
14. Bladder cancer
15. Ovarian Cancer
16. Breast Cancer
Lump-sum Benefit
1. The benefit amounts for the lump-sum benefit paid upon initial diagnosis are:
a. $25,000 for a diagnosis of a severe form of cancer (Stage 3,4).
b. $6,250 for the less severe cancer (Stage 1,2).
c. The definitions of severe/less severe will appear in the legislation.
2. Recurrence Provision – The legislation will provide for a 2X recurrence benefit allowing benefits for more than one diagnosis of cancer.
a. A 2X recurrence benefit funds up to $50,000 of indemnity benefit paid for severe and/or less severe cancer diagnosis.
b. The second diagnosis must occur at least 180 days after the first diagnosis.
3. Offset/Coordination – The lump-sum benefit will not offset or coordinate with any existing health insurance program. (meaning coverage benefits from other policies will not affect the payout of this policy.)
4. Taxability of Lump-sum Benefit – As the cost of the lump-sum benefit is not paid by the firefighter, it is deemed income by the IRS and is therefore taxable at the federal level. The legislation will state the benefit is not taxable at the state level. (we can’t do anything about federal)
Disability Benefit
1. Benefit Trigger – A firefighter must be unable to perform their duty as a firefighter due to cancer.
2. Date of Disability Due to Cancer – The disability elimination period commences on the date the firefighter is no longer able to work due to cancer.
3. 180 Day Elimination Period – The legislation will require that a firefighter remain disabled for 180 days before receiving monthly benefits.
4. Three Year Benefit Duration – The program will provide a monthly benefit for up to three years providing the firefighter remains disabled.
5. Monthly Benefit
a. Salaried firefighters would receive a monthly benefit that is 60% of their monthly earnings to a maximum of $5,000.
b. Volunteer firefighters would receive a flat monthly benefit of $1,500.
c. The disability benefit will coordinate with other sources of disability income.
d. The disability benefit will not coordinate with any insurance product the firefighter purchased for themselves or their families.
e. As the cost of the lump-sum benefit is not paid by the firefighter, it is deemed income by the IRS and is therefore taxable at the federal level.
f. The legislation will state the benefit is not taxable at the state level.
Continuation
1. Continuation of the Benefit Program – The program will allow a firefighter to continue the indemnity benefit when they retire or leave the fire service provided the firefighter pays the insurance premium.
2. Rates and Plan Design – The firefighter would have access to the same indemnity benefit at the same program rates.
Premium Rates and Plan Design
1. Premium Rates – The program will offer the same rate for all eligible firefighters regardless of age, fire service occupation, employer (state, municipality, county or private fire departments) or location.
2. Plan Design – The program will offer the same base plan design satisfying the mandate of the legislation.
Effective Date
1. Start Date of the Program – January 1, 2022. (depending upon passage date to allow for budgeting)
Revision of G.S. 143-166.2 6 (e)
In addition our current Line of Duty Death Benefit under GS 143 will be amended to include the additional cancers covered by this bill.
1. Adding Additional Compensable Cancers to Firefighter Line of Duty Benefit – Currently G.S. 143-166.2 6 (e) lists four cancers – Mesothelioma, Testicular, Intestinal and Esophageal cancers.
2. The legislation will revise the line of duty death benefit to include the cancers consistent with the cancer insurance.

2021/2022 NC Legislative Agenda Amended
Thank you for joining and participating in our Legislative Advocacy Group. For those of you new to Capital Impact, this will provide a means for you to track legislation, and for us to reach out to you for assistance in lobbying and advocacy. This years Legislative Session begins a 2 year biennial session that concludes next year. As a new Session begins, all Legislative Bills start fresh with new numbers. As new Bills are introduced in the House or Senate that impact the fire and emergency services, we will post those and provide summaries for you to follow. As always, we’ll keep you posted as things progress.
The combined Legislative Committee of the NC State Firefighters’ Association, the NC Association of Fire Chiefs, and the Professional Firefighters and Paramedics of NC have been meeting and discussing priorities since late last year.
Our Number 1 Priority for this year is to pass legislation that provides financial protection to firefighters who are diagnosed with Cancer, and to find an funding source. The approach will be to develop an Insurance Bill that will provide up front money upon diagnosis, monthly support for firefighters who are out of work due to treatments, other benefits, and expand the coverage in this Bill and the existing Line of Duty Death Benefit to include a more comprehensive list of 16 cancers. When this Bill is introduced we will provide additional information. As you talk to Legislators early in the session, please let them know this is the Number 1 priority for the fire service.
Other State Legislation the Committee has discussed pursuing include:
– Separation Allowance for Career Firefighters with Funding
– Search and Rescue Funding for S&R Teams
– Allowing Rear Facing Blue Lights on Fire Apparatus
– Property Tax Exemption for Volunteers
– Updates and Improvements in the Fire and Rescue Pension Program

(This will be based on our ability to meet under Covid Conditions that may exist)
May 5th we will go as a group to the Legislative Building and meet and greet legislators and let them know what our goals are. Our goal is to have at least one member from each legislative district in Raleigh, so we need our members from the East, West and Piedmont to attend. Welcome to the 2021 Legislative Tracking System
2021/2022 NC Legislative Agenda
Thank you for joining and participating in our Legislative Advocacy Group. For those of you new to Capital Impact, this will provide a means for you to track legislation, and for us to reach out to you for assistance in lobbying and advocacy. This years Legislative Session begins a 2 year biennial session that concludes next year. As a new Session begins, all Legislative Bills start fresh with new numbers. As new Bills are introduced in the House or Senate that impact the fire and emergency services, we will post those and provide summaries for you to follow. As always, we’ll keep you posted as things progress.
The combined Legislative Committee of the NC State Firefighters’ Association, the NC Association of Fire Chiefs, and the Professional Firefighters and Paramedics of NC have been meeting and discussing priorities since late last year.
Our Number 1 Priority for this year is to pass legislation that provides financial protection to firefighters who are diagnosed with Cancer. The approach will be to develop an Insurance Bill that will provide up front money upon diagnosis, monthly support for firefighters who are out of work due to treatments, other benefits, and expand the coverage in this Bill and the existing Line of Duty Death Benefit to include a more comprehensive list of 16 cancers. When this Bill is introduced we will provide additional information. As you talk to Legislators early in the session, please let them know this is the Number 1 priority for the fire service.
Other State Legislation the Committee has discussed pursuing include:
– Separation Allowance for Career Firefighters
– Search and Rescue Funding for S&R Teams
– Allowing Rear Facing Blue Lights on Fire Apparatus
– Property Tax Exemption for Volunteers
– Updates and Improvements in the Fire and Rescue Pension Program
Put on your Calendar Today….Legislative Day at the NC General Assembly is Currently Planned for May 5th.
(This will be based on our ability to meet under Covid Conditions that may exist)
May 5th we will go as a group to the Legislative Building and meet and greet legislators and let them know what our goals are. Our goal is to have at least one member from each legislative district in Raleigh, so we need our members from the East, West and Piedmont to attend. Please mark your calendars now and plan to attend. Specific information will be posted on our web site as plans are finalized.
