An Informal Compilation and Discussion of Certain Fire Service-Related General Statutes

Introduction
Over my 38 plus years working in the fire service at the State level I’ve often been asked questions concerning General Statutes or Laws affecting the fire service. Over the years, in order to save myself time and effort in research, I began to collect a listing of where to find certain laws, rules, etc. The following is my compilation of NC General Statutes, Federal Laws, and Administrative Law Listings for State and Federal Regulations that affect fire and rescue departments. Although the listing is certainly not complete, it addresses many of those I received the most questions concerning. There also may be errors where State Statutes or Rules change, or are recodified a different number. This list still remains helpful in these cases because when the statue is looked up it usually explains where it has been recodified.
I’ve compiled these in some order of relevance or questions, since it made them easier for me to find. It may not be that relevant for others.
From a State perspective, information is provided in General Statutes and Rules, or Administrative Procedures. Just as a brief explanation, they are codified by number in the following formats.

(3) Additional Rate on Property Coverage Contracts. – An additional tax at the rate of seventy-four hundredths percent (0.74%) applies to gross premiums on insurance contracts for property coverage. The tax is imposed on ten percent (10%) of the gross premiums from insurance contracts for automobile physical damage coverage and on one hundred percent (100%) of the gross premiums from all other contracts for property coverage. Twenty percent (20%) of the net proceeds of this additional tax must be credited to the Volunteer Fire Department Fund established in Article 87 of Chapter 58 of the General Statutes. Twenty percent (20%) of the net proceeds must be credited to the Department of Insurance for disbursement pursuant to G.S. 58-84-25. Up to twenty percent (20%), as determined in accordance with G.S. 58-87-10(f), must be credited to the Workers’ Compensation Fund. The remaining net proceeds must be credited to the General Fund.
The following definitions apply in this subdivision:
- Automobile physical damage. – The following lines of business identified by the NAIC: private passenger automobile physical damage and commercial automobile physical damage.
- Property coverage. – The following lines of business identified by the NAIC: fire, farm owners’ multiple peril, homeowners’ multiple peril, nonliability portion of commercial multiple peril, ocean marine, inland marine, earthquake, private passenger automobile physical damage, commercial automobile physical damage, aircraft, and boiler and machinery. The term also includes insurance contracts for wind damage.

Motor Vehicles Laws relating to the Fire Service in North Carolina
Drivers License
20-4.01 (3C) CDL Commercial Drivers License
(3D) Commercial Motor Vehicle – 26,001 Pounds GVWR
20-7 (A) (3) Class C License entitles a licensee to drive a
single vehicle with a GVWR of less than 26,001 pounds or
any such vehicle towing another vehicle with a GVWR not
in excess of 10,000 pounds, both of which are exempt
from Article 2C, A Class C Licensee who is a volunteer
member of a municipal or rural fire department. A
volunteer member of a rescue squad, or a volunteer
member of EMS may also drive any firefighting vehicle,
rescue vehicle, EMS vehicle or combination of these
vehicles, regardless of GVWR when necessary in the
performance of his duty.
20-37.16 (E) (2) Waives a commercial driver’s license (CDL) for
all vehicles used as firefighting or emergency equipment
